Resolved:

That the amended application be granted subject to:

1. The Mandatory Conditions set out in Appendix 1 of the report of the Corporate Director Enterprise; Tourism and the Environment; and

2. The Conditions drawn from the operating schedule set out in Appendix 2 of the report, with an amendment to Condition 5 as follows:
"The licensee shall ensure that an effective Closed Circuit Television (CCTV) surveillance system that records in real time the entire licensable areas, the entrance/exit…" the remainder of the condition remains the same as set out in the Appendix.

749The Sub Committee considered an application by Nigindan Badmanadan for the grant of a premises licence in respect of 492 Sutton Road, Southend-on-Sea, Essex SS2 5PN.

The Application was presented by Mr G Biagioni (the Applicant's Agent). The Applicant, Mr Badmanadan, was in attendance at the meeting.

The Sub Committee noted that no letters of objection had been received from any of the Responsible Authorities. Representations had however, been received from four interested parties, including one from a local Councillor, namely Councillor Van Looy, along with 335 letters from residents accompanying his representation. Of these, seven residents attended the hearing and gave oral objections. Councillor Ayling also attended the hearing and spoke in his capacity as Ward Councillor.

Their concerns related to the need for another convenience store within an area already serviced by such facilities, the need for more variety of amenities in this parade, the possibility of increased anti-social behaviour, the consumption of alcohol in nearby parks and the potential effect of this on children.

At the hearing the Applicant agreed to amend the application to reduce the hours the premises are open to the public from 6.00 a.m. until 11.00 p.m. to 7.00 a.m. until 10.30 p.m. daily and the hours for licensable activities from 10.00 a.m. until 11.00 p.m. to 11.00 a.m. until 10.00 p.m. daily.

The Sub Committee considered all the evidence and submissions that had been made at the meeting and the written documentation that had been presented prior to the hearing. The Sub Committee also had regard to the National Guidelines and the Borough Council's Statement of Licensing Policy.

It was explained that no evidence had been received from the Responsible Authorities to corroborate the fears of anti-social behaviour. Additionally, the evidence relating to the commercial demand for another convenience store was not a matter for consideration by the Sub Committee as this was a matter for the planning authority and the market. It is not a matter for a licensing authority in discharging its licensing functions.
